1. Prerequisites *Algemene competenties A basic knowledge of international private law (conflicts of law) and comparative law are useful

2. Objectives (expected learning outcomes) Insight in thepossibilities and difficulties of harmonising private law in Europe. Insight in the status of the various activities and tendencies in this field. basic knowledge of the Draft Common Frame of Reference (DCFR) for European Contract law.
3. Course content The course deals with several aspects of the harmonisation of private law in the EUropean union, on the one hand the contents of the existing or future European private law,on the other hand questions of methodology, formation of law and division of competences. As to the matters of private law treated, the course deal with the so-called Acquis communautaire in the field of private law, as found in legislation and case law of the EU (hard law) and the - probably growing - ius commune in the field of private law in the EU, especially the Draft Common Frame of reference seen against the background of a comparison of the contract law of the Member States. The course also discusses the division of competences in private law between the Union and the Member States, the possibilities and difficulties of harmonisation of private law, he possible methods and the role of the different sources of law.
